This website, accessible at https://magicpill.fr (the “Site”), is published by:

Magic Pill, a trade name operated by Marie-Sophie Ruet, Sole Proprietorship registered with the Paris Trade and Companies Register under number 994 950 673 R.C.S. Paris.

The business operates under the VAT exemption scheme.
VAT not applicable, pursuant to Article 293B of the French General Tax Code.

The Site is hosted by Shopify Inc., located at Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (contact: +1 650 253 0000).

General Provisions

These Terms and Conditions of Sale (the “Terms”) apply exclusively to online sales of products offered on the Site.

They are accessible at any time on the Site and may also be provided upon request.

By placing an order (via checkbox or validation button), the Customer acknowledges having read and accepted these Terms. Order confirmation constitutes full acceptance.

Products

The Site offers clothing and fashion accessories (the “Products”) for sale to private individuals acting for personal use (the “Customer”).

Each Product includes a description of its essential characteristics.
Product images are non-contractual.

The Customer is responsible for their internet access and equipment and confirms that their system is secure and functional.

Customer Account

To place an order, the Customer must provide an email address and create an account via a secure login link.

The Customer agrees to:

provide accurate and up-to-date information;
maintain confidentiality of login credentials;
notify the Company in case of unauthorized use.

The Company reserves the right to suspend or terminate access in case of misuse.

Orders & Pre-orders

Product availability is indicated subject to stock.

If a Product becomes unavailable after ordering, the Customer will be informed and may choose between:

a credit note, or
a refund within 30 days.

Orders are firm and final.

For pre-orders, payments do not constitute deposits within the meaning of French law.

Product descriptions are provided with care, but minor inaccuracies may occur.
Colors may vary depending on screen settings.

The Company reserves the right to refuse or cancel an order in legitimate cases (e.g. payment issues, disputes, suspicious activity).

Payment

All orders require payment.

Payments are processed securely via Shopify Payments.
Accepted method: credit card.

Transactions are encrypted (SSL), and banking details are never stored on the Site.

Orders are validated only after payment authorization.

If payment fails, the order is automatically cancelled.

Pricing

Prices are listed in euros (€), all taxes included (TTC), excluding shipping.

Shipping fees are specified before order confirmation.

Promotional prices apply only during the stated period.

Contract Formation

The contract is formed upon order confirmation.

The “double-click” process constitutes an electronic signature and full acceptance of the order.

Order details and invoices are archived and may serve as legal proof.

Retention of Title

The Company retains ownership of the Products until full payment has been received.

Shipping & Delivery

Shipping costs and delivery times are specified at checkout.

Delivery times are indicative and expressed in business days.

For pre-orders, extended timelines apply depending on production.

Products are delivered to the address provided by the Customer.
The Company cannot be held responsible for errors in delivery details.

No delivery is made to PO boxes or hotels.

Upon delivery, the Customer must check the condition of the package.
Any issue must be reported within 3 days to hello@magicpill.fr.

Right of Withdrawal

Customers have 14 days from receipt to return a Product.

Returns must be initiated via the “Orders” section of the customer account or by contacting us.

Return shipping costs are borne by the Customer.
A flat €5 fee will be deducted from the refund.

Non-returnable items include:

custom-made or personalized products.

Returned items must be in perfect condition, unworn, unwashed, and in original packaging.

Refunds are issued within 14 days after receipt and inspection of the return.

Intellectual Property

All content on the Site (texts, images, logos, designs, etc.) is the exclusive property of the Company and protected by intellectual property laws.

Any unauthorized use is strictly prohibited.

Liability

The Company shall not be held liable for:

misuse of the Site by the Customer;
force majeure events;
technical issues related to the Internet.

The Site may be temporarily unavailable for maintenance or updates.

Legal Guarantees

Products benefit from:

the legal guarantee of conformity (Articles L.217-4 et seq. of the French Consumer Code);
the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

Customers have 2 years to act under the legal guarantee of conformity.

The Site may contain links to third-party websites.
The Company is not responsible for their content or policies.

General Provisions

If any clause is deemed invalid, the remaining provisions remain in force.

Failure to enforce a clause does not constitute a waiver.
